  • It is the customer’s responsibility to ensure the information on the customer order confirmation is accurate to avoid delivery and product issues. If this information is incorrect, you must notify Zion Custom Containers of any changes in writing. In case of delay in conveying any change in details or omission of crucial information after the transport and delivery quotation issue, we reserve the right to revise our charges. We shall bill the additional costs after delivery, which the customer must pay in full upon receipt of the invoice.

  •  We assure container delivery only after complete customer order confirmation.

  • As the haulers typically charge for the initial delivery and return of the container to the depot in case of cancellation for any reason, Zion Custom Containers passes such costs, including gate in fees, depot charges, etc., to the customers if they have omitted or not provided critical information. Such charges will be equivalent to the original transportation charges levied by the hauler and not the amount mentioned on the customer quotation or order, irrespective of any discounts or special transportation rates to the customer. We shall provide the customer with a copy of the original transport order on demand.

  • The customer shall ensure that the ground upon which the contractor delivers container(s) is flat and firm for a smooth and safe landing. Our haulage contractor will not be accountable if the container does not open or it racks due to uneven ground, regardless of completion or non-completion of the site visit.

  • The customer must ensure that the ground used to deliver the container(s) is flat, firm, and made of appropriate material. Providing a suitable base for placing the container is the customer’s duty. The delivery vehicle needs enough space to turn to transport and position the container.

  • Placing an order with Zion Custom Containers implies that the customer agrees with all the container sale and delivery terms.

  • The onus of obtaining a signed copy of the arrival and departure times from the driver lies with the customer. This copy is an essential document displaying the name of the driver.

  • The Company and the haulage contractor shall not assume liability for any damage caused to your property or the property of any third parties if a vehicle sustains damage while making a delivery, such as hitting a gate post due to insufficient or restricted access. The customer shall bear the expenses incurred due to the vehicle’s damage.

  • If the customer wants delivery cancellation, he must notify Zion Custom Containers by two working days (excluding Saturday and Sunday) of expected delivery by 8 am. In case of short cancellation notice or failure to execute this contract, we have the right to charge the costs related to delivery, vehicle return, and others incurred by us.

  • We retain the right to modify this agreement or these terms without advance notice.

  • Unless otherwise agreed to in writing by Zion Custom Containers and the customer, delivery includes practical offload of the container(s) straight to and immediately adjacent to the spot of the vehicle on a weekday between 7 am and 8 pm. The delivery fee includes 30 minutes of on-site time; the customer must pay for any additional time at $XX + VAT per hour, billed in increments of 15 minutes, etc. Although we provide expected arrival times, there may still be delays due to, but not limited to, depot delays, traffic delays, weather, etc. Due to these factors, all delivery times are estimates, and Zion Custom Containers assumes no responsibility for any delays caused by such occurrences. The only way for guaranteed delivery time is to book a vehicle for the entire day.

  • The transport cost estimates are not based on the possibility of the container being lifted over obstacles, the vehicle being driven over grass or mud, or any other non-standard offload. If there is a deviation from the typical offload, the customer will receive an invoice accordingly after delivery and will pay it fully upon its receipt.

  • The ‘new container,’ also known as ‘one-way tripper,’ is a container with cargo transported by sea for the first time. It may have bangs, scrapes, rust, corrugation damage, and paint damage due to the nature of the equipment.

  • The ‘used container’ is a container with cargo transported once or more than once by sea. The users may have also used it for storage, road transport, or other purposes. It may have bangs, scrapes, rust, groove, and paint damage.

  • A-grade containers are high-quality used containers, whereas B-grade containers are less expensive options that may require minor repairs. A container with only a CSC plate is ready for shipping on the order confirmation, irrespective of its condition.

  • We deliver the ordered accessories separately or with the container to your premises and provide you with the relevant details as quickly as possible. The customer must receive them in person as we inform them about the delivery date in advance.

  • Zion Custom Containers performs all conversion work, including painting, as per ‘industry standard’ unless otherwise specified. Therefore, it is the customer’s responsibility to inform Zion Custom Containers of any bespoke specifications of container works (for example, but not limited to shelving, lighting, heating, painting, locks, and lockboxes) or accessories before ordering. Any images of available accessories are indicative only and may reflect a bespoke order. Zion Custom Containers will offer the next available option; however, to ensure delivery of the same, the customer order confirmation must contain the customer’s tailored specifications. The customer shall pay for all conversion services upfront, and there are no refunds due to the bespoke nature of the job. We do not remove decals and stickers from a painted container unless specifically requested in writing, acknowledged by Zion Custom Containers in writing, and quoted accordingly.

  • Modifying shipping containers may or may not render the CSC plate invalid following changes. The Zion Custom Containers removes the CSC plate after substantial modifications and does not conduct testing for shipping, load bearing, lifting, or safe working loads except as expressly specified at the quote stage.

  • The Company does not attach CSC plates to the cut-down or custom-built containers (anything other than 20ft & 40ft long), which are not considered standard ISO containers. The quote stage mentions their testing requirements for shipping, load-bearing, lifting, or safe working loads.

  • We only perform Grafo-therm treatment to the roof unless specified on the signed customer order confirmation.

  • We do not supply a lockbox and lock unless otherwise mentioned in the customer confirmation.

  • Customers can contact us if they require an explanation of the terms and conditions they agree to while placing an order.

  • Zion Custom Containers deliver containers of all sizes on a vehicle up to 68 ft in length and over 10 ft wide. By placing an order with us, the customer confirms that his delivery site has sufficient access for a vehicle this size unless instructed and agreed otherwise in writing.

  • Regardless of the credit terms provided, Zion Custom Containers retain ownership of the container sold until the customer pays for it fully, receiving clearance. No third party can present the container as an asset or capital to administrators, liquidators, or creditors if Zion Custom Containers retain its title in case of non-payment by the customer for it and no receipt of written confirmation from us.

  • Zion Custom Containers does not electrically test the specialty units (e.g., offices, canteens, toilets, drying rooms, etc.) before leaving the depot if not specified on the customer order confirmation. Also, the Company does not refurbish “As-Is” equipment in any way and sells it as seen unless stated on the customer order confirmation. This equipment does not carry any guarantees. “Used” equipment does not come with warranties either and is sold in quality used condition. All specialty equipment has individual specifications, which vary from unit to unit; we deliver specific units as detailed in the customer order confirmation. If the customer quotes a particular piece or container, the customer order confirmation must specify this. Else, the Company will supply the specialty units on a “next in stack” basis.

  • The customer order confirmation signed by the customer before delivery provides a complete and comprehensive detail of the customer order as understood by Zion Custom Containers. The Company disclaims any liability for faulty equipment delivered if customers fail to ensure that the customer order confirmation document contains all the items to the specifications and detail ordered, described, and required.

  • The customers implicitly agree to these terms and conditions when they place an order with Zion Custom Containers orally, in writing, or through payment.

  • The rates stated by Zion Custom Containers are valid for 7 days; discounted prices are valid for 24 hours unless otherwise agreed in writing by Zion Custom Containers. The Company does not reserve any equipment; equipment remains its asset until delivered to, paid for, and signed for by the customer.

  • The customer understands and hereby acknowledges that Zion Custom Containers sells all equipment on a strict “as is” basis and provides no express or implied guarantees or assurances regarding the suitability of the equipment for usage in a particular setting or nation.

  • The customer assumes the risk of equipment when the Company delivers the same or makes it available for pickup. Time is of no essence concerning delivery or collection.

  • Zion Custom Containers will not be responsible for any direct, indirect, or consequential loss of (but not limited to) profit, market, or delay-related effects under any circumstances.

  • All prices quoted, if not specified, are exclusive of value-added tax.

  • These conditions and the conditions of the customer order confirmation will always prevail over any other terms, including a customer’s supply conditions. Zion Custom Containers assumes no other conditions than these and accepts only the requirements of the customer order confirmation unless expressly agreed in writing by a director of Zion Custom Containers.

  • Any delivery time or date is simply an estimate, and Zion Custom Containers will not be responsible for any indirect losses brought on by delivery delays.

  • While paying for an order through an international payment platform, the customer must choose “remitter to pay all charges” to be responsible for both parties’ bank fees. As the bank charges Zion Custom Containers’, there will be automatic generation of an invoice for $XX + VAT, which will be payable by customers immediately.

  • If there is a problem with any aspect of the customer order, the customer must follow the issued complaints procedure in all cases.

  • Unless otherwise mentioned, any photographs provided indicate the series type of a container on record rather than the exact container delivered. Therefore, customers should always note the terms related to the condition.

  • Any advice by Zion Custom Containers or any of its employees, whether in the form of designs, drawings, specifications, or verbal counsel, is for guidance only and without any assumption of liability. Zion Custom Containers or its employees shall not be held responsible for the customer’s failure to independently evaluate the correctness and suitability of any such advice and to accept or reject the recommendation accordingly. Moreover, the customer will indemnify Zion Custom Containers free from any claims made by anybody for personal injury, property loss, or damage, including all costs related to it, regardless of the cause.

  • The individual who signs or accepts the Terms and Conditions of Sale and Customer Order Confirmation affirms and certifies that they are allowed by the customer to enter into the agreement on their behalf. In such cases, Zion Custom Containers has the right to treat the customer as being contractually committed by these terms and conditions.

  • These terms and conditions are applicable under US law, and the parties agree to comply with the exclusive jurisdiction of the US courts.

  • Suppose a customer cancels his order of converted or modified containers with 48 hours’ notice. In that case, he is liable to pay for the costs incurred in preparing the given order. The charges include expenses on modifications, painting, moving containers from one depot to another, and others.
